Draft for review

DRAFT POLICY. This policy is a draft that must be reviewed by a legal adviser before launch. It can be edited before publication.

Draft notice

This notice is a draft prepared for legal review before launch. It is intended to align with the Protection of Personal Information Act, 2013 (POPIA) and is not yet in force.

Who we are

SAMEDAY PRINT is the responsible party for personal information collected through this website and in providing our printing services. You can contact our Information Officer at info@samedayprint.co.za.

What we collect at registration

When you create an account, we collect the information needed to provide quotes, orders and invoices:

  • Your name and contact details, such as email address and phone number
  • Company name and VAT number, if you order on behalf of a business
  • Billing and delivery addresses
  • Your login credentials, stored securely
  • Your marketing preference, which is optional

What we collect when you order

  • Order details, quotes, proofs and approvals
  • Artwork and files you upload, which may contain personal information about you or others
  • Payment confirmation and transaction references (we do not need to store full card details)
  • Communications with us about your orders
  • Basic technical information such as device and browser data needed to run and secure the website

Why we use your information

We use personal information only for purposes related to our services and our legal obligations:

  • Creating and managing your account
  • Preparing quotes, processing orders, sending proofs and arranging collection or delivery
  • Verifying payments and preventing fraud
  • Issuing invoices and VAT documents and keeping financial records
  • Responding to queries, complaints and returns
  • Sending marketing, only if you have opted in
  • Complying with legal and regulatory requirements

Transactional messages

Messages about your account, quotes, proofs, invoices and orders are transactional. They are necessary to provide the service you asked for and are sent whether or not you opt in to marketing. They are separate from marketing and do not contain promotional content beyond what is needed to complete your transaction.

Marketing preferences

Marketing consent is separate and entirely optional. It is not required to create an account, request a quote or place an order.

  • The marketing opt-in at registration is unticked by default
  • We send marketing only if you actively opt in
  • You can unsubscribe at any time using the link in any marketing message or by updating your account preferences
  • Unsubscribing from marketing does not affect transactional messages about your orders

Sharing your information

We share personal information only where needed to provide our services or comply with the law, for example with payment providers, delivery providers, IT and hosting service providers, and professional advisers. We require these parties to protect your information. We do not sell your personal information. If any provider processes information outside South Africa, we will take steps required by POPIA to ensure adequate protection.

Retention

We keep personal information only as long as needed for the purpose it was collected, or as required by law. Financial records, such as invoices and transaction records, are retained for the periods required by tax and company legislation. Uploaded artwork and account information are kept for as long as your account is active, to support reorders, unless you ask us to delete them and we are not required to keep them. Retention periods are to be confirmed in legal review.

Security

We take reasonable technical and organisational measures to protect personal information against loss, damage and unauthorised access. If we become aware of a security compromise affecting your personal information, we will notify you and the Information Regulator as required by POPIA.

Your rights

Subject to POPIA, you have the right to:

  • Ask whether we hold personal information about you and request access to it
  • Ask us to correct or update inaccurate information
  • Ask us to delete information we are no longer entitled to keep
  • Object to processing in certain circumstances, including direct marketing
  • Withdraw marketing consent at any time
  • Lodge a complaint with the Information Regulator of South Africa

Returns and reprints for custom printed goods

Our products are printed to your specification, so they cannot be resold. For that reason, we cannot accept returns for a change of mind or for errors in artwork you supplied and approved. This does not affect any rights you have under applicable law, including the Consumer Protection Act, 2008 where it applies.

Defects and our errors

If your order is defective or does not match the approved proof or order specification because of our error, we will reprint the affected items, or offer a refund or another appropriate remedy. Examples include:

  • Printing or finishing defects outside normal printing tolerances
  • Wrong product, size, material or quantity compared with your order
  • Damage caused before collection or in our delivery
  • Content that differs from the approved proof

Customer artwork errors

We are not responsible for errors in artwork, content or specifications that you supplied or approved. Examples include:

  • Spelling mistakes, wrong dates or incorrect details in approved artwork
  • Low-resolution images supplied by you, where we had flagged or you had approved them
  • Missing bleed or content too close to the edge in files you supplied
  • Colour differences between your screen and the printed result within normal tolerances
  • Choosing the wrong size, quantity or product

How to report a problem

Please inspect your order on collection or delivery and contact us at info@samedayprint.co.za as soon as possible, with your order number, a description of the problem and clear photos. We may ask you to return or make the items available for inspection. The time period for reporting problems is to be confirmed in legal review, and any statutory periods will apply.

Same-day surcharge refunds

If we accepted a same-day commitment and could not meet it, the unearned priority surcharge is refunded as set out in our Same-Day Priority Production Terms, together with any other remedy required by law.
